Terms and Conditions

1. Scope and provider

1.1 These Terms and Conditions apply to all contracts between Mainey More, owner Daniel Borowi, Burggrafenstraße 101, 41061 Mönchengladbach, Germany (email: mail@maineymore.com), hereinafter "Provider", and consumers who order goods through the online shop at www.maineymore.com.

1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

2. Conclusion of contract

2.1 The presentation of goods in the online shop is not a binding offer but an invitation to order.

2.2 By completing the checkout (clicking the button to place your order with payment obligation), you submit a binding offer to buy the goods in your cart. Before submitting, you can review and correct your details at any time.

2.3 We confirm receipt of your order by email. This confirmation is not yet an acceptance. The contract is concluded when we ship the goods to you or expressly declare acceptance.

2.4 We store the contract text. You receive the order details by email. You can view these terms at any time in the shop. Contract languages are German and English.

3. Prices and shipping costs

3.1 The prices shown in the shop at the time of your order apply, in euros.

3.2 All prices are final prices. Due to the small business regulation under Section 19 of the German VAT Act (UStG), no value added tax is charged or shown.

3.3 Shipping is free worldwide. For deliveries to countries outside the European Union, customs duties, import VAT or other charges of the destination country may apply. These are borne by the customer unless expressly included in the price.

4. Payment

4.1 Payment is made using the payment methods offered at checkout, for example PayPal, Klarna, credit card, Apple Pay, Google Pay or Shop Pay. Available payment methods may differ by country and cart.

4.2 The purchase price is due upon completion of the order. For payment methods from third parties, their own terms also apply, for example those of Klarna.

5. Production and delivery

5.1 Our pieces are made to order. Delivery usually takes 7 to 12 business days from the order. For individual pieces this can differ. The information on the product page is decisive.

5.2 We deliver to the delivery address given at checkout. Orders with several items may be delivered in several shipments without additional shipping costs.

5.3 As soon as your order has shipped, you will receive an email with tracking information.

5.4 Regarding colours and patterns: Screen displays may differ from the actual colour. For printed and knitted pieces, small production-related differences in pattern and placement are possible and are not a defect.

6. Retention of title

The goods remain our property until full payment.

7. Right of withdrawal

Consumers have a statutory right of withdrawal. The details are set out in the withdrawal notice, which is part of these terms, including the model withdrawal form.

8. Warranty

8.1 The statutory rights regarding defects apply.

8.2 Please report defects as soon as possible, with a photo, by email to mail@maineymore.com so that we can find a solution quickly. This is not a requirement for your statutory rights.

9. Liability

9.1 We are liable without limitation in cases of intent and gross negligence, for injury to life, body or health, under the Product Liability Act and where we have given a guarantee.

9.2 In cases of slightly negligent breach of essential contractual obligations, our liability is limited to the foreseeable damage typical for this type of contract. Essential contractual obligations are those whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely. Otherwise, liability for slight negligence is excluded.

10. Vouchers

10.1 Vouchers can only be redeemed in the online shop and are valid for the purchase of goods. Cash payment is excluded. The voucher is valid for three years, starting at the end of the year in which it was issued.

10.2 If the voucher value is lower than the value of the goods, the remaining amount must be paid with another payment method.

11. Copyright

All designs, patterns, photos, texts and the mask logo on this website and on our products are protected by copyright. Use without our written consent is not permitted.

12. Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country in which they have their habitual residence.

14. Final provisions

Should individual provisions of these terms be wholly or partly invalid, the validity of the remaining provisions remains unaffected.
